These terms explain who operates the site, how its information may be used and the boundaries between website content and contracted Thintech services.

Status, scope and acceptance

These terms apply to thintech.co.uk, its public pages, search, FiNN, enquiry forms, downloads and related public website functionality. By using the website, you agree to these terms. If you do not agree, do not use the website.

The website may be visited by anyone, but Thintech's services and proposals are intended for organisations and people acting in a business or professional capacity. If you use the site for an organisation, you confirm that you have authority to act for it.

Other policies and customer agreements

The Acceptable Use Policy and Privacy Policy also apply where relevant. They form part of the rules for using the website.

These website terms do not govern the supply of consultancy, support, hosting, managed services or other customer services. A signed proposal, order, service schedule, statement of work or customer agreement takes priority for the service it covers.

Submitting an enquiry, requesting a brochure, using FiNN or discussing a requirement does not create a customer contract, place an order or commit either party to proceed.

Website information and no professional advice

Website content is provided for general information and initial evaluation. It is not legal, regulatory, financial or other professional advice, and it is not a substitute for a discovery exercise, technical assessment, scoped proposal or contract tailored to your environment.

We take reasonable care with published information, but technology, law, vendor programmes and service specifications change. We do not promise that every page, brochure, case study or downloadable item will always be complete, current, available or error-free.

Do not make a security, compliance, procurement, migration or operational decision solely from website content. Ask Thintech to validate material facts for your circumstances.

FiNN and automated assistance

FiNN is an automated assistant that uses prepared Thintech information and may use third-party artificial-intelligence services. Its answers may be incomplete, outdated or wrong and do not create a representation, warranty, quotation, service commitment or contract.

FiNN does not provide legal, regulatory, security, financial or other professional advice. Material decisions and service details must be confirmed with an authorised Thintech representative.

Do not send FiNN passwords, authentication codes, private keys, payment information, special-category personal data, confidential customer information or detailed production-system data. FiNN interactions are handled as described in the Privacy Policy.

Permitted use

Thintech grants you a limited, revocable, non-exclusive and non-transferable permission to access the public website and to download or print reasonable extracts for lawful personal use or internal business evaluation.

You must not use the website in breach of the Acceptable Use Policy, remove ownership notices, misrepresent content as your own, modify material in a misleading way or use Thintech branding to imply approval, partnership or endorsement.

Availability, changes and website security

The website is made available without a guaranteed service level. We may change, maintain, suspend, restrict or withdraw any part of it, including FiNN and downloads, for operational, legal or security reasons.

We take proportionate steps to protect the website but do not guarantee that it will be uninterrupted, compatible with every device or free from vulnerabilities, errors or harmful code. You are responsible for suitable device, browser, network, backup and security controls.

You must not attack or test the website without written authorisation. Suspected vulnerabilities should be reported under the responsible disclosure section of the Acceptable Use Policy.

Information you submit

You confirm that information submitted through a form, email or FiNN is accurate to the best of your knowledge, lawful to provide and does not infringe another person's rights. If it relates to an organisation, you confirm that you are authorised to provide it.

Standard website forms and email are not appropriate for passwords, live credentials, private keys, payment-card information, special-category personal data, exploit code or sensitive production information. Contact Thintech to arrange an appropriate channel.

Unless Thintech has agreed otherwise in writing, submitting information does not create a duty of confidentiality beyond duties imposed by law. Personal information is handled under the Privacy Policy.

Intellectual property

Unless stated otherwise, copyright, trade marks, database rights where applicable, design rights and other intellectual property in the website, text, graphics, brand assets, methodologies and downloads are owned by or licensed to Thintech Services Ltd.

Thintech, the Thintech pixel mark, TDM, TRE, TPMM, Think Health, Think Response, Think Integrated, Think Open, Think Managed Desktops and flexiDesk are names or identifiers used by Thintech. No licence to use them is granted except for ordinary reference to our services.

You may not reproduce, republish, sell, licence, systematically extract, mirror or create a commercial dataset from website material without written permission, except where applicable law expressly permits the use.

Links to and from the website

You may link to a public page in a fair and lawful way that does not damage our reputation or imply an association, approval or endorsement that does not exist. Do not frame the website, mirror it or display it as part of another service without permission.

Links to third-party websites are provided for convenience. Their content, availability, security, accessibility, privacy practices and terms are controlled by their operators. A link does not, by itself, amount to Thintech approval or endorsement.

Our responsibility

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited.

For business users, and to the extent permitted by law, Thintech excludes implied conditions, warranties and representations relating to this free public website. Thintech is not liable for loss of profit, revenue, business, contracts, anticipated savings, data or goodwill, or for indirect or consequential loss, arising from use of or inability to use the website.

Website content does not replace the warranties, remedies or liability arrangements in a signed customer agreement. If you are acting as a consumer, nothing in these terms affects mandatory statutory rights, and exclusions apply only to the extent the law permits.

Restriction or termination of access

We may restrict, block or end access where we reasonably believe these terms or the Acceptable Use Policy have been breached, where access creates a security or legal risk, or where action is required to protect the website, Thintech or another person.

Rights and obligations concerning intellectual property, confidentiality, security, liability, governing law and investigation continue where their nature requires them to survive.

Changes to these terms

We may update these terms to reflect changes in law, website functionality, technology or business operations. Changes apply prospectively from the effective date shown on this page.

Please review this page when returning to the site. Material changes will be made reasonably prominent where practical.

General terms

If a court finds part of these terms unlawful or unenforceable, that part will be treated as modified to the minimum extent necessary and the remaining terms will continue.

A delay in enforcing a right is not a waiver. No person other than you and Thintech Services Ltd has a right to enforce these website terms under the Contracts (Rights of Third Parties) Act 1999.

These terms are the entire agreement about use of the public website only. They do not replace any confidentiality agreement, customer contract, order, service schedule or statement of work.

Governing law and jurisdiction

These terms and non-contractual matters arising from website use are governed by the law of England and Wales.

Business users agree that the courts of England and Wales have exclusive jurisdiction. If you are a consumer, the courts available under the mandatory law applying where you live remain available to you.
